1. Acceptance of Terms
By downloading, installing, or using Drive. ("the Service"), a cloud storage service, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
These terms constitute a legally binding agreement between you ("User") and Drive. ("Company", "we", "us"). The Service is provided for your personal, non-commercial use only.
2. Eligibility
You represent and warrant that:
- You are at least 13 years of age (or the age of digital consent in your country)
- You have the full power and authority to enter into this agreement
- You are not located in a country subject to a U.S. government embargo
- You are not on any U.S. government list of prohibited or restricted parties
- You will not use the Service in violation of any applicable law or regulation
3. Account Registration
To use Drive., you must register an account using your email address. You agree to provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.
4. Privacy and Data
Your privacy is fundamental to Drive. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you consent to the practices described in the Privacy Policy.
Drive. uses end-to-end encryption by default. We cannot access, read, or provide your files, documents, or media content to any third party, including law enforcement, except as required by applicable law.
5. Acceptable Use
You agree not to misuse the Service. Prohibited activities include:
- Attempting to interfere with, compromise, or bypass the Service's security or encryption
- Reverse-engineering, decompiling, or disassembling the app
- Using the Service for any illegal purpose or in violation of any laws
- Harassing, threatening, or intimidating other users
- Distributing malware, viruses, or other harmful code through the Service
- Impersonating any person or entity
- Spamming, phishing, or engaging in fraudulent activity
- Using automated tools (bots, scrapers) to interact with the Service
- Violating the intellectual property rights of others
- Uploading or storing content that infringes any third-party rights
- Exceeding storage limits or using the Service as a backup or archiving service for commercial purposes without authorization
Violation of these rules may result in immediate suspension or termination of your account without notice.
6. Purchases and Refunds
Drive. may offer paid features, subscriptions (including storage plans), or in-app purchases. All purchases are processed through the Apple App Store or Google Play Store. Refunds are subject to the policies of the respective store and our Refund Policy.
We reserve the right to change pricing with reasonable notice. Free storage tiers may become paid at our discretion. We will not retroactively charge for features that were previously free.
7. Termination
We may suspend or terminate your access to the Service at any time, without prior notice, for:
- Violation of these Terms
- Conduct that we believe is harmful to other users, third parties, or our business interests
- Request by law enforcement or government agency
- Extended periods of inactivity
Upon termination, your right to use the Service immediately ceases. We may delete your stored data after a reasonable period following termination. You may delete your account at any time through the app settings.
8. Intellectual Property
The Drive. name, logo, design, and all related intellectual property are owned by Drive. The app and its original content, features, and functionality are protected by copyright, trademark, and other applicable laws.
You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit written permission.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. Drive. makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the Service, or the information, content, or materials included therein.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We are not responsible for any damage to your device or loss of data resulting from use of the Service. You are responsible for maintaining your own backups of files stored on the Service.
10. Limitation of Liability
To the maximum extent permitted by law, Drive. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or alteration of your data
- Any loss of files or content stored on the Service
- Any conduct or content of any third party on the Service
- Any bugs, viruses, or other harmful components
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be resolved in the courts of Kota, Rajasthan.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page, and we will notify you via the app or email for material changes. Your continued use of the Service after changes constitutes acceptance of the new Terms.
